eGift Card Terms of Service
Welcome to Rosecler.com (“The Site").
ROSECLÉR® ("we, us, or our") provides the content and services available on The Site to you subject to the following terms and conditions regarding Customer Service and others included in Terms of Service, Privacy Policy, Cookie Policy and other policies which you may find throughout our Site in connection with certain functionality, features or promotions as well as customer service, all of which are deemed a part of and included within these terms and conditions (collectively, "Terms & Conditions").
You must be 21 years old or the age of majority in your jurisdiction in order to make a purchase on our Site. If you are under 21 years old or the age of majority in your jurisdiction, then you may not make a purchase on our Site. If you are under 21 years old, you may browse our Site. However, you may not provide personal information to us nor register on The Site. The Site is not directed to children under 13 years old. By accessing or using The Site, you are acknowledging that you have read, understand, and agree, without limitation or qualification, to be bound by these Terms and Conditions.

ROSECLÉR® reserves the right to audit a Member's account without prior notice to ensure compliance with our Terms and Conditions; any Partner’s terms and conditions; and any other applicable rules, regulations or terms and conditions. During the course of an audit, the Member’s account will be temporarily suspended, and the Member will not be permitted to access his/her account nor perform any transactions.
ROSECLÉR® also reserves the right to cancel any order due to unauthorized, altered, or ineligible use of any Rewards Points/offer and to modify or cancel due to system error or unforeseen problems.
1. GENERAL TERMS
Roseclér eGift Cards (called as Gift Card/ eGift Card/ eGift Cards) are issued by Roseclér website only. The eGift Card Terms of Services set forth below at the Site may be updated or modified at any time without prior notice.
2. REDEMPTION
ROSECLÉR® eGift Cards may only be used as payment for purchases at this Site. eGift Cards cannot be used in retail stores, airports or department store locations. eGift Cards can be redeemed for merchandise or services which will be charged at the time of order placement. If the eGift Card can cover the value of an entire order, that amount will be deducted from the card. Customers cannot choose to redeem a partial amount for an order. Any balance left in the eGift Card can be used for future purchases. It cannot be redeemed for another eGift Cards or exchanged for cash.
Purchases paid for with eGift Cards are also subject to applicable sales tax upon delivery to your designated country or region. No sales tax is charged when buying our eGift Cards.
3. EXPIRATION
ROSECLÉR® eGift Cards have one (1) year expiration date from the date of purchase.
4. RETURNS
You may not return or cancel your eGift Card after it is used or partially used. Purchasers who wish to cancel an order for an eGift Card may do so prior to it being used. Any refund request must be made by the original purchaser of the eGift Card within 30 days from the date of receipt of the email in which the eGift Card was delivered. Please allow 10 business days for the Refund process after our approval to the application. The refund will be credited to the original purchaser at his/her original form of payment channel only. We reserve the right to charge you for any associated administrative and bank charges incurred.
5. LOST OR STOLEN EGIFT CARDS
Please safeguard your eGift Card and its corresponding code, and do not share this information with anyone. If you are gifting this card to a friend, please remind your friend safeguard the information as well.
If your eGift Card is lost or stolen, you should immediately email us at customerservice@rosecler.com. Please attach the purchaser's confirmation email is presented as proof of purchase. We will verify your application, and if we accept your application, we will cancel the specific eGift Card immediately and discuss with you about the next step. Please note that any application involving a used or a partially-used eGift Card will not be accepted.
6. RISK OF LOSS
Ownership and risk of loss with respect to eGift Cards passes to the purchaser once we send an email notification to the recipient.
7. LIMITATIONS
Promotional offers and discounts are not applied to the purchase of eGift Cards, and purchases of eGift Cards will not be used to satisfy promotional thresholds. Please check on the terms and conditions of each Promotional offer /discount event regularly for updates.
8. PAYMENT METHODS
ROSECLÉR® eGift Cards can be purchased by the payment methods stated in item 2.1 under Shopping in Customer Service.
9. DELIVERY INFORMATION AND REQUIREMENTS FOR eGIFT CARD PURCHASERS
eGift Cards are delivered via email. Both the sender and recipient’s name and email address are included for the recipient.
We are not responsible for eGift Cards that are undeliverable or not received due to your failure to correctly enter the recipient's email address. Please check to make sure the email address of the recipient is correct and contact our Customer Services if you suspect the recipient did not receive his/her eGift Card. Should an email be returned to us due to inaccurate delivery information for the recipient, we will attempt to contact you for a valid email address.
Sometimes a recipient's email address is correct, but he or she does not access the eGift Card within a reasonable period after the requested delivery date. The following is a list of the most common reasons why this may occur:
- Spam filter blocked email or routed it to a bulk/spam folder
- Recipient's firewall blocked the email
- Email inbox is over size limit
Please ensure that the recipient's spam filter does not block emails for our eGift Card emails.
NOTE: Orders may be automatically suspended in the event of a discrepancy between the purchaser's information provided to ROSECLÉR® with information provided by the purchaser's financial institution. If you do not receive confirmation that your eGift Card was sent by the requested date, please contact our Customer Services immediately. You will be asked to provide your order information and email address.
10. PERSONALIZED MESSAGING
If you wish to add a personal message when purchasing an eGift Card, simply type your message in the Message Field on the eGift Card preview. Personal messages are limited in length to the space provided on the eGift Card. There is no additional charge to include a personalized message. We reserve the right to remove or replace inappropriate, offensive or otherwise objectionable messages without prior notice.
11. SMS
By using the text messaging functionality and providing the eGift Card recipient's mobile number, you consent to initiate one (1) text message from Roseclér to the recipient with the eGift Card link.
12. LIMITATION OF LIABILITY
The materials on the website are provided "as is". To the extent permitted by law, we make no warranties of any kind, either express or implied, with respect to any materials on the website or the ROSECLÉR® eGift Cards, including without limitation, warranties of title, merchantability, fitness for a particular purpose or non-infringement of intellectual property. Your use of the website is at your sole risk, and you assume full responsibility for any costs associated with your use of the website. Neither ROSECLÉR® nor our parent companies, subsidiaries, affiliates, partners and/or licensors and licensees shall be liable to you for any damages resulting from your use of the website. If an eGift Card is non-functional, your sole remedy, and our sole liability, shall be replacement of such eGift Card after accepting your application.
13. DISPUTES
Mindful of the high cost of litigation, not only in dollars but also in time and energy, you and we agree to the following dispute resolution procedure: In the event of any controversy, claim, action or dispute arising out of or related to any transaction conducted on the website, an eGift Card, or the breach, enforcement, interpretation, or validity of these Terms of Services or any part of it ("Dispute"), the party asserting the Dispute shall first try in good faith to settle such Dispute by providing written notice to the other party(s) (by registered mail) describing the facts and circumstances (including any relevant documentation) of the Dispute and allowing the receiving party 30 days in which to respond to or settle the Dispute. 14. GOVERNING LAW
With respect to any dispute regarding The Site, all rights and obligations and all actions contemplated by these Terms & Conditions shall be governed by the Laws of Hong Kong (HKSAR) . Any dispute relating in any way to your visit to The Site shall be submitted to confidential arbitration in HKSAR and you submit to the jurisdiction and proceedings thereof, except that, to the extent you have in any manner violated or threatened to violate our intellectual property rights or the intellectual property rights of our affiliates, partners, licensors, licensees or otherwise have a cause of action in equity, we may seek injunctive or other appropriate relief in any court of competent jurisdiction and you consent to jurisdiction and venue in any such court for such purposes. Arbitration under this agreement shall be conducted under the Consumer-Related Disputes Supplementary Rules then prevailing with the HK Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under these Terms & Conditions shall be joined to an arbitration involving any other party subject to this Terms & Conditions, whether through class arbitration proceedings or otherwise.

16. DISCREPANCIES
If there is any conflict between the English and other translated language versions of this eGift card Terms of Services, the official English version shall prevail.
