ROSECLÉR® ("we, us, or our") provides the content and services available on The Site to you subject to the following terms and conditions regarding Customer Service and others included in Terms of Service, Privacy Policy, Cookie Policy and other policies which you may find throughout our Site in connection with certain functionality, features or promotions as well as customer service, all of which are deemed a part of and included within these terms and conditions (collectively, "Terms & Conditions").
You must be 21 years old or the age of majority in your jurisdiction in order to make a purchase on our Site. If you are under 21 years old or the age of majority in your jurisdiction, then you may not make a purchase on our Site. If you are under 21 years old, you may browse our Site. However, you may not provide personal information to us nor register on The Site. The Site is not directed to children under 13 years old. By accessing or using The Site, you are acknowledging that you have read, understand, and agree, without limitation or qualification, to be bound by our Terms & Conditions.

ROSECLÉR® reserves the right to audit a Member's account without prior notice to ensure compliance with our Terms and Conditions; any Partner’s terms and conditions; and any other applicable rules, regulations or terms and conditions. During the course of an audit, the Member’s account will be temporarily suspended, and the Member will not be permitted to access his/her account nor perform any transactions.
ROSECLÉR® also reserves the right to cancel any order due to unauthorized, altered, or ineligible use of any Rewards Points/offer and to modify or cancel due to system error or unforeseen problems.
ROSECLÉR® respects your concerns about privacy and values the relationship we have with you. The main purpose of collecting personal information is to continuously improve our product offerings and services to our members. We NEVER sell or profit from the sales of individual or collective information of our members. We also work with top internet firms to avoid security breaches. All information gathered is for internal use only, but we may invite third party service providers to help collect and/or analyze such information.
This Privacy Policy describes the types of personal information we collect about our customers, whether on The Site, via our social media, via one of our mobile applications, through an authorized retailer or at one of our events, how we use the information, with whom we share it, and the choices available to our customers regarding our use of the information. Unless otherwise indicated at the time when you provide your personal information, your information may be consolidated by us. 4. INFORMATION WE COLLECT BY AUTOMATED MEANS
When you visit The Site, view or click on our online advertisements (including our advertisements on third party websites), visit our social media pages or download and use one of our mobile applications, we also collect certain information about your usage or device by automated means or by using technologies such as cookies, web server logs and web beacons. For example, if you use one of our mobile applications, we may collect your IP address, your unique device identifier (or other device identifier) and/or geo-location data in order to offer you certain features or functionalities within that mobile application. For your convenience, our mobile applications may also include functionality that allows you to remain logged in to the application so that you do not have to reenter a password each time you want to access the application. For that reason, if you choose to remain logged in to the application on your mobile device, we strongly recommend you to enable the Passcode Lock security feature on your mobile device to protect against unauthorized access to and use of your mobile device and your account.
4.1 THIRD PARTY WEB ANALYTICS SERVICES
We may use third party web analytics service providers to administer and use technologies such as cookies, web server logs and web beacons to help us analyze how visitors use The Site, our social media network pages or our mobile applications, such as those of Adobe Site Catalyst and/or Google Analytics. 5. INFORMATION WE SHARE
We do not rent lists, or sell or otherwise disclose personal information we collect about you, except as described here. We may share your personal information with:

6. TEXT MESSAGING
If you so elect, you may provide your mobile phone number to Roseclér. By submitting your mobile phone number, you consent to receive text message alerts from ROSECLÉR® containing product and event information, cosmetics tips or promotions that may be sent using automated dialing systems (“Text Messages”). Your consent to receive Text Messages is not otherwise required to purchase any goods or services from us. You may not consent to receive Text Messages on behalf of someone else or provide someone else’s phone number. You agree to enter into, sign and receive your consent to receive Text Messages electronically.
We may also obtain the date, time and content of your messages in the course of your use of Text Messages. We will use the information we obtain in connection with our Text Messages in accordance with this Privacy Policy.
From time to time you may be asked to provide your mobile phone number to ROSECLÉR® in connection with specific text messaging, which is in addition to the general ROSECLÉR® marketing text messaging program. That text messaging program may have additional or different terms and conditions from those set forth above, which will be presented to you at the time that you opt-in to receive those text messages.
Text Messages are distributed via third party mobile network providers and, therefore, we cannot control certain factors relating to message delivery or guarantee availability or performance of this service, including liability for transmission delays or message failures. You may unsubscribe from receiving ROSECLÉR® Text Messages (if any) at any time by following instructions to do so at the end of the Text Messages or email customerservice@rosecler.com
7. PUSH NOTIFICATIONS AND IN-APP ALERTS AND UPDATES
When you download one of our mobile applications, we may provide you with the option to opt in to receive push notifications from ROSECLÉR® on your mobile device in connection with that mobile application. These push notifications may include promotional communications regarding ROSECLÉR® products and services. You may, after downloading the applicable mobile application, opt out of receiving push notifications by adjusting the settings on your mobile device. Opting out of push notifications will not affect other communications you receive from ROSECLÉR®, such as email communications. You also may receive alerts and updates within our mobile applications regarding ROSECLÉR® products and services or your ROSECLÉR® accounts. If you decide to uninstall the applicable mobile application from your mobile device, you may not receive these alerts and timely updates.
8. YOUR RIGHTS AND CHOICES
We offer you certain choices in connection with the personal information we collect from you, such as how we use the information and how we communicate with you. To update your preferences, ask us to remove your information from our mailing lists or submit a request, please contact us by email to customerservice@rosecler.com
9. EMAIL OPT-OUT
You can at any time tell us not to send you marketing communications by clicking on the unsubscribe link within the marketing emails you receive from us or by contacting us via email.
10. POSTAL MAIL OPT-OUT
You can ask ROSECLÉR® to stop sending you marketing communications by postal mail by following the instructions that may be included in a particular promotion. You also can request that we refrain from sending you promotional postal mail by contacting us via email.
11. TEXT MESSAGE OPT-OUT
You may unsubscribe from receiving ROSECLÉR® Text Messages (if any) at any time by following instructions to do so at the end of the Text Messages or by contacting us via email.
12. SOCIAL NETWORKING APPLICATION OPT-OUT
To remove or delete our social media application from your social networking account, follow the instructions from the specific social network, for example follow the instructions at the Facebook Help Center for Facebook related matters.
13. GEO-LOCATION INFORMATION
When you visit The Site or use one of our mobile applications, we may ask you for your geo-location. This is for us to load preset preferences such as local language and currency, in the event you’d like to locate the nearest authorized retailer or program offering, or to provide specific news regarding deliveries and limitations if applicable. You may choose not to share your geo-location details by adjusting your mobile device’s location services settings. To decline from sharing your geo-location details, follow the instructions on your mobile device on changing the relevant settings; otherwise, please contact your service provider or device manufacturer.
14. WITHDRAWING CONSENT
You may withdraw any consent you previously provided to us, or object at any time on legitimate grounds, to the processing of your personal information. We will apply your updated preference going forward, but you may still receive materials sent just prior to your update. In some circumstances, withdrawing your consent to our use or disclosure of your personal information will mean that you cannot take advantage of some of our products or services.
15. REVIEWING, UPDATING AND MODIFYING PERSONAL INFORMATION
Subject to applicable law, you may have the right to request access to and receive details about the personal information we maintain about you, update and correct inaccuracies in your personal data, and have the information blocked or deleted, as appropriate. The right to access personal information may be limited in some circumstances by local law requirements. 16. DATA TRANSFERS
We may transfer the personal information we collect about you to countries other than the country in which the information was originally collected and your personal information may be processed and stored outside of your country of residence. 17. CHILDREN'S PRIVACY
Children under 13 years of age may browse The Site, but may not provide personal information to us and may not download any of our mobile applications. The Site does not market and is not directed to children under the age of 13. We do not knowingly collect personal information from children under the age of 13 on The Site. And, if we become aware that we have inadvertently received personal information from a visitor under the age of 13 on The Site, we will delete such information from our records at the earliest opportunity.
18. HOW WE PROTECT PERSONAL INFORMATION
We maintain appropriate administrative, technical and physical safeguards designed to protect the personal information you provide against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. However, no security system is perfect and we cannot promise that information about you will remain secure in all circumstances, including the security of your data during transmission to us or the security of data on your mobile device.
19. MAINTAINING AND DELETING PERSONAL INFORMATION
You may cancel your account with us at any time by contacting us by email at customerservice@rosecler.com
If you wish to delete part of your user content, please include the following information in your deletion request: first name, user name/screen name (if applicable), email address associated with our website and/or mobile applications, your reason for deleting the posting, and date(s) of posting(s) you wish to delete (if you have it). We may not be able to process your deletion request if you are unable to provide such information to us. Please allow up to 10 business days to process.
We reserve the right to refuse service and/or terminate accounts without prior notice if these Terms & Conditions are violated or if we decide, in our sole discretion, that it would be in our best interest to do so. Shall your account be cancelled, whether by your choice or by ROSECLÉR®’s decision, your order history will be deleted and all of your member’s benefits including Reward Points will be forfeited.
20. LINKS TO OTHER WEBSITES
Our website may provide links to other websites for your convenience and information. These websites may operate independently from us. Linked sites may have their own privacy notices or policies, which we strongly suggest you review if you visit any linked websites. To the extent any linked websites you visit are not owned or controlled by us, we are not responsible for the other sites’ content, any use of these sites, or the privacy practices of these sites.
21. UPDATES TO OUR PRIVACY POLICY
This Privacy Policy may be updated periodically and without prior notice to you to reflect changes in our personal information practices or changes in applicable laws. We will post a prominent notice on our website to notify you of any significant changes to our Privacy Policy and indicate at the top of the Policy when it was most recently updated. As legally required, we may also send important changes via email.
